TIERRA VERDE COMMUNITY ASSOCIATION, INC. CONSTRUCTION ACKNOWLEDGEMENT LETTER
Reference: Block ________, Lot ________, Unit ________ Street Address ____________________________________________ Please indicate R Zone R1 _____ R2 _____ R3_____ The undersigned does hereby acknowledge and agree: a. All improvements on the property will be performed in compliance with all applicable local, state and federal codes, laws and ordinances, including the restrictions and covenants of the Tierra Verde Community Association, Inc., and the rules, standards, regulations and procedures established by the Tierra Verde Community Association Architectural Review Board. b. There shall be a construction dumpster–a large roll-off container—serviced by a solid waste refuse company on the property during the entire period of construction to contain all rubbish, trash and construction debris. The use of adjacent properties for this purpose is strictly prohibited. Moreover, the homeowner and contractor must keep all debris and trash from blowing onto adjecent properties. c. There shall be a commercial, portable toilet on the construction site, which is regularly maintained during the entire construction period. d. Upon completion of construction, and prior to occupancy, all residential sites shall have a minimum of (5) trees with a minimum diameter of (4) inches and a fully sodded lot. All landscaping shall be completed in accordance with the landscape design submitted to and approved by the Tierra Verde Community Association. e. Application will be made to the Pinellas County Highway Division for a driveway utilities/right-of-way permit. f. Applicant acknowledges that property addresses are authorized only by Pinellas County Building Department Technical Services, Plan Review. Applicant must verify the address with Pinellas County. All maps at the Tierra Verde Community Association are informational only and shall not be relied upon to serve any legal requirements. g. The applicant, contractor and homeowner have received a copy of the Tierra Verde Community Association deed restrictions and covenants and the builders information package. h. I/We hereby acknowledge that if there are any violations, I/we will assume all costs, including attorneys’ fees, as well as court costs required to correct violation. i. Applicant and contractor acknowledges that Tierra Verde Utilities, Inc., requires the installation of elder valves at the property. It is the builder’s responsibility to notify Utilities, Inc., prior to the commencement of construction. j. Only the Association Board is authorized to grant variances or exceptions from the restrictions and any applicable rules, standards, regulations, and procedures established by the Architectural Review Board. Upon the written request of a Grantee, the Association, provided that written notice of the Grantee’s request is provided to all contiguous property owners and other property owners within a 300-foot radius of the subject Grantee at least 30 days prior to the date when the Association Board will meet to consider grating such a variance or waiver. k. I, the homeowner, have discussed these plans with my builder and understand all aspects of the plans ____yes, ____no; I acknowledge that all setback requirements are within the accepted standards ____yes, ____no; I acknowledge that all height restrictions are within the accepted standards ____yes, ____no; I acknowledge that the outside air conditioner must by outside of the side & rear setbacks and that no air conditioning equipment shall be placed in front of the home ____yes, ____no; I acknowledge that fences will not exceed the height restrictions and shall be built with finished side out ____yes, ____no; I acknowledge that pools, pool cages and decks conform to accepted standards and do not encroach into easements ____yes, ____no; I acknowledge review and understanding of the required specifications for plan review provided by the Tierra Verde Community Association Architectural Review Board and accept all further aspects of this and all building forms for this plan review ____yes, ____no. _______________________________________________ _______________________________________________ _______________________________________________
